On February 11, 2025, data protection authorities in the United Kingdom, Ireland, France, South Korea and Australia published a joint declaration on the creation of trustworthy data governance to encourage the development of innovative artificial intelligence and confidentiality protector (“AI”) (“joint declaration”). In the joint declaration, the DPAs recognize “the importance of supporting players in the AI ecosystem in their efforts to comply with the rules for data protection and confidentiality and to help them to reconcile innovation with the respect of the rights of individuals”.
The joint declaration refers to the “leading role” that DPAs have in “shaping data governance” to meet the evolutionary challenges of AI. More specifically, the joint declaration indicates that the authorities will commit:
- Promote a shared understanding of legal reasons for the processing of personal data in the context of AI training.
- Exchange information and establish a shared understanding of proportional security measures, to be updated in accordance with the processing of evolving AI data.
- Monitor the technical and societal impacts of AI.
- Reducing legal uncertainties and creating innovation opportunities when data processing is considered essential for AI.
- Strengthen interactions with other authorities to improve consistency between different regulatory frameworks for AI systems, tools and applications, including those responsible for competition, consumer protection and intellectual property.
